Welcome to Hmong Date (the "App"). These Terms of Service ("Terms") govern your access to and use of Hmong Date. By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
You are responsible for the information you provide, and for keeping your account credentials confidential. You agree to provide truthful and accurate information about yourself, including your real name, age, and identifying photos.
You agree NOT to do any of the following on Hmong Date:
Violation of any of these rules may result in immediate suspension or permanent termination of your account, without refund.
You retain ownership of the photos, text, and other content you upload ("Your Content"). By posting Your Content on Hmong Date, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), and display Your Content solely for the purpose of operating and improving the App.
You represent and warrant that Your Content does not infringe on the rights of any third party and complies with these Terms.
Hmong Date has zero tolerance for harassment, hate speech, illegal activity, and objectionable content. You can report other users from any profile card or chat screen (tap the ⋯ menu → Report). We review all reports and typically respond within 24 hours for serious violations.
You can also block another user at any time from their profile. Blocking prevents the other user from seeing your profile or contacting you.
We reserve the right — but not the obligation — to remove any content or account that violates these Terms.
Hmong Date does not conduct criminal background checks or verify the identity of every user. We provide tools like photo verification, reporting, and blocking — but ultimately, your interactions with other users are at your own risk. Please exercise caution when meeting anyone in person for the first time.
Hmong Date offers a paid subscription tier called "Hmong Date Unlimited" that unlocks additional features. Pricing and features are described within the App at time of purchase.
Subscriptions are auto-renewing. When you subscribe:
You can manage or cancel your subscription at any time in your device's store account settings:
Uninstalling the App does not cancel your subscription. You must cancel through your store account.
All purchases are final and non-refundable, except where required by law. Refund requests are handled by the store where you purchased:
If a free trial or introductory offer is provided, you will be charged the standard subscription price at the end of the trial unless you cancel at least 24 hours before it ends. Introductory offers may be limited to first-time subscribers.
You may delete your account at any time from Settings → Delete Account within the App, or via our web form: Delete My Account. Deletion is permanent and cannot be undone.
We may suspend or terminate your account at any time, without notice, if we reasonably believe you have violated these Terms. If your account is terminated for violation, you are not entitled to a refund of any unused subscription time.
The Hmong Date App, its name, branding, design, and code are the exclusive property of Hmong Date and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.
The App is provided "as is" and "as available", without any warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any information (including profiles of other users) is accurate or reliable.
To the fullest extent permitted by law, Hmong Date, its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use or inability to use the App.
In no event shall our total liability to you for any claim arising out of these Terms or the App exceed the greater of (a) the amount you paid to Hmong Date in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars (US $100).
You agree to defend, indemnify, and hold harmless Hmong Date and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debts arising from: (i) your use of the App; (ii) your violation of these Terms; (iii) your violation of any third-party right, including intellectual property, publicity, or privacy; or (iv) any content you post on the App.
These Terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the App shall be resolved by binding arbitration in Minnesota under the rules of the American Arbitration Association, except that either party may bring a small-claims action in a court of competent jurisdiction.
Class-action waiver: you agree to bring claims only on an individual basis, not as part of a class action.
If you access the App on an iOS device: you acknowledge that these Terms are between you and Hmong Date only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support. In case of failure to conform to any warranty, Apple may refund the purchase price; beyond that, Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms and may enforce them against you.
If you access the App on an Android device: your use is also governed by Google Play Terms of Service.
We may update these Terms from time to time. We will post the updated Terms in the App and update the "Last updated" date at the top of this page. Material changes will be announced in the App or by email. Your continued use after a change constitutes acceptance.
